Welcome to BentID.com. These Terms of Service ("Terms") govern your use of the BentID.com identity verification and secure document management platform ("Service"), provided by Brooks & Keitt SARL ("Company", "we", "us", "our"), a Swiss-based company. By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you disagree with any part of the terms, then you may not access the Service.

1. Acceptance of Terms & Eligibility

By creating an account and using BentID.com, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. You confirm that you accept and agree to be bound by these Terms.

2. Description of Service

BentID.com provides a suite of services centered around digital identity:

Identity and Age Verification: A secure service that allows you to verify your identity and age once, and then use that verified status with compatible third-party services (e.g., BentBox) that integrate with BentID.
Secure Document Management: A comprehensive service for the creation, management, and secure signing of digital documents, such as model release forms, using a verified identity.

3. Secure Document Signing

Our platform facilitates the execution of legally binding documents, such as model release forms.

Verified Signatures: Signatories use their verified BentID account to execute documents, linking their signature to a securely verified identity.
Document Integrity and Non-Repudiation: Once a document is signed by all parties, BentID generates a unique cryptographic signature (a "hash") of the final document. This digital fingerprint, along with a secure timestamp, is permanently recorded. Any subsequent alteration to the document will change its cryptographic signature, making tampering evident. This process ensures the integrity, authenticity, and non-repudiation of the signed agreement.

4. Identity Verification Process

To use our Service, you must undergo identity and age verification. You agree to provide truthful and accurate information.

Data Submission: You will be required to submit data such as images of government-issued photo IDs and a live selfie for biometric comparison. All data is handled in accordance with our Privacy Policy.
Your Warranty: By submitting a document, you represent and warrant that the document is genuine, valid, unaltered, and that you are the person depicted and named in it.
Third-Party Systems: BentID.com may leverage verifications from trusted third-party providers. Your use of the Service is also subject to the terms of these providers where applicable.

5. Re-verification Requirements

We may require a new verification of your identity under certain circumstances, including but not limited to: the expiry of your government-issued ID, changes in regulations, or for security and fraud prevention purposes.

6. User Responsibilities

You agree to:

Provide accurate, current, and complete information.
Maintain the security and confidentiality of your account credentials.
Notify us immediately of any unauthorized use of your account.
Take sole responsibility for the legal content, suitability, and enforceability of any documents you upload or create, such as model release forms.
Use the Service only for lawful purposes and in accordance with these Terms.

7. Prohibited Uses

You agree not to misuse the Service or help anyone else to do so. You agree not to, and not to attempt to, do any of the following in connection with the Service:

Probe, scan, or test the vulnerability of any system or network.
Breach or otherwise circumvent any security or authentication measures.
Use fraudulent, stolen, or altered documents for verification.
Create an account for anyone other than yourself or impersonate another person.
Access, tamper with, or use non-public areas of the Service.
Interfere with or disrupt any user, host, or network, for example by sending a virus, overloading, flooding, spamming, or mail-bombing any part of the Services.
Use the Service for any illegal purpose or in violation of any applicable laws.

We reserve the right to investigate and suspend or terminate your account without notice for any violation of this section.

9. Disclaimers and Limitation of Liability

"AS IS" Service: The Service is provided "AS IS," at your own risk, without express or implied warranty or condition of any kind.
Third-Party Services: We are not responsible for the content, policies, or practices of any third-party services (like BentBox) that you access using your BentID.
Verification Accuracy: While we use advanced systems, no verification system is infallible. We are not liable for the failure to detect fraudulent documents or for any losses resulting from such an instance.
No Legal Advice: We do not provide legal advice. Document templates are for informational purposes only. You are solely responsible for consulting with a legal professional.
Limitation of Liability: To the fullest extent permitted by Swiss law, Brooks & Keitt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, data, use, or goodwill.

10. Indemnification

You agree to indemnify, defend, and hold harmless Brooks & Keitt SARL and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property right or privacy right; or (d) the content or legal enforceability of documents you upload or sign via the Service.

11. Termination

You are free to stop using our Service at any time. We reserve the right to suspend or terminate your access to the Service with or without notice if:

You are in breach of these Terms.
Your use of the Service could cause a real risk of harm or loss to us or other users.
You haven't accessed our Service for 12 consecutive months.

Upon termination, your right to use the Service will immediately cease. Data will be handled as described in our Privacy Policy.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the substantive laws of Switzerland, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be resolved by the competent courts of Sion, Valais, Switzerland, which shall have exclusive jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to the new terms taking effect. By continuing to use the Service after the revisions become effective, you agree to be bound by the revised terms.
