Welcome to BentID.com! These Terms of Service ("Terms") govern your use of the BentID.com identity aggregation and verification service ("Service"), provided by Brooks & Keitt, a Swiss-based Software Company. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Service.

BentID.com is solely an identity and age verification system. We do not host, display, or provide any content (photos, videos, or otherwise) with adult connotations. Our role is strictly to verify your identity and age to enable your access to third-party services that require such verification.

1. Acceptance of Terms

By creating an account and using BentID.com, you confirm that you are at least 18 years of age and that you accept and agree to these Terms. These Terms constitute a legally binding agreement between you and Brooks & Keitt.

2. Our Service

BentID.com provides a secure, one-time identity and age verification service. Upon successful verification and payment of a one-time fee, your verified status will be available for use with compatible third-party services (e.g., BentBox) that integrate with BentID.com. We strive to offer a seamless and convenient experience, reducing the need for repeated verification processes across different platforms.

3. Identity Verification Process

To use our Service, you will be required to undergo an identity and age verification process. This involves securely submitting personal data, which may include:

Images or scans of government-issued photo identification documents (e.g., passport, driving license).
A live selfie or video for biometric comparison and liveness detection.
Other personal information necessary to confirm your identity and age.

In order to provide a valid and robust verification system, we collect names and associated date of births to be sure that the same ID cannot be used twice. This is important for the purpose of the legislation and verification.

BentID.com may leverage already existing verifications from trusted third-party providers (such as Stripe or Yoti) and will regularly add support for other private and government-issued ID verification systems as they become available. All data submitted for verification is handled in accordance with our Privacy Policy.

4. Re-verification Requirements

While BentID aims to provide a "verified once, always available" experience, certain circumstances may require a new verification or re-verification of your identity and age. This includes, but is not limited to:

Expiry of Third-Party Verifications: Some third-party identity service providers that BentID leverages may have an expiry date attached to their verification results. In such cases, a new verification might be required after that expiry date to maintain your active verified status.
Expiry of Uploaded ID: If the government-issued identification document you originally uploaded to BentID has expired, a new verification using a valid, unexpired ID will be required.
Regulatory Changes: Changes in applicable laws or regulations (e.g., UK Online Safety Act) may necessitate a new verification process to ensure ongoing compliance.
Security Concerns: If there are security concerns, suspicious activity, or a need to re-confirm your identity for fraud prevention purposes, we may require re-verification.

Any re-verification process will follow the same secure procedures and privacy commitments outlined in these Terms and our Privacy Policy.

5. Fees and Payment

A one-time fee of £1.99 is required for the identity and age verification service. This fee is non-refundable once the verification process has been initiated, regardless of the outcome of the verification. We reserve the right to change our fees at any time, but any changes will be communicated to you in advance.

6. User Responsibilities

You agree to:

Provide accurate, current, and complete information during the registration and verification process.
Keep your account credentials secure and confidential.
Notify us immediately of any unauthorized use of your account or any other breach of security.
Use the Service only for lawful purposes and in accordance with these Terms.

7. Data Privacy and Security

Your privacy and the security of your data are paramount to us. BentID.com is provided by Brooks & Keitt, a Swiss-based Software Company with extensive experience in data handling and secure storage. Your sensitive ID documents and personal information are uploaded directly to our highly secure systems and are never shared with anyone or any third-party services for purposes other than the core age verification check. 8. Disclaimers and Limitation of Liability

Service Availability: We strive to ensure the continuous availability of our Service, but we do not guarantee uninterrupted or error-free operation.
Third-Party Services: BentID.com is not responsible for the terms, policies, or content of any third-party services that you access using your BentID. Your use of such services is subject to their respective terms and conditions.
Accuracy of Verification: While we use advanced systems and comply with regulations, no verification system is infallible. We do not guarantee that our verification will prevent all instances of fraud or misrepresentation.
Limitation of Liability: To the fullest extent permitted by law, Brooks & Keitt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; and (d) unauthorized access, use, or alteration of your transmissions or content.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Switzerland.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
